1. ABOUT US AND THESE TERMS
1.1 The Dusty Dash is operated by Dean de Haast ("we", "us", "our"), trading as The Dusty Dash, of 45 Loampit Vale, Lewisham, London, England.
1.2 These Terms and Conditions ("Terms") govern your booking and participation in any Dusty Dash event ("Event"). By submitting a booking, you ("the participant", "you") agree to be bound by these Terms in full.
1.3 If you do not agree to these Terms, you must not submit a booking.

2. WHAT'S INCLUDED
2.1 Your booking includes:
Use of a Dusty Dash vehicle for the duration of the rally
3 nights' accommodation (one night at each stage: Welcome Event, Midway Event, Finish Line Event)
Entry to all three events, including food, drinks, and alcohol as provided
Accommodation is basic shared lodging; specific arrangements will be confirmed ahead of departure
2.2 Excluded from your booking, unless explicitly stated otherwise in writing: flights, visas, travel insurance, personal expenses, fuel, vehicle damage excess, and any costs arising from delays, breakdowns, or schedule changes outside our control.
2.3 We reserve the right to make reasonable changes to the published itinerary, accommodation, or events where necessary due to operational, safety, or logistical reasons, provided the overall nature and value of the experience is not materially diminished.
3. BOOKING AND PAYMENT
3.1 A booking is confirmed only upon our receipt of a completed booking form and the non-refundable deposit set out in Section 3.2.
3.2 A deposit of 20% of the total trip cost is payable at the time of booking and is non-refundable in all circumstances, save as set out in Section 6 (Cancellation by Us).
3.3 The remaining balance is due no later than 6 weeks before the departure date. If payment is not received by this date, we reserve the right to treat your booking as cancelled by you, in which case Section 4 applies.
3.4 All prices are quoted in GBP unless otherwise stated. We reserve the right to correct genuine pricing errors at any time prior to full payment being accepted.
3.5 Payment is accepted via the methods stated on our website at the time of booking.
4. CANCELLATION BY YOU
4.1 All cancellations must be submitted in writing to thedustydash@outlook.com. The cancellation date is the date we receive your written notice.
4.2 The following cancellation charges apply based on when notice is received:
More than 3 months before departure — deposit forfeited; all other payments refunded in full
Between 6 weeks and 3 months before departure — 50% of total trip cost forfeited
Less than 6 weeks before departure — 100% of total trip cost forfeited; no refund issued
4.3 Your deposit is non-refundable in all circumstances, including under Section 4.2.
4.4 We strongly recommend taking out travel insurance that covers cancellation, as set out in Section 11.
5. PARTICIPANT TRANSFERS
5.1 If you are unable to attend, you may transfer your booking to another person provided that:
You notify us in writing at least 14 days before departure
The replacement participant meets all eligibility requirements in Section 7
Both you and the replacement participant accept joint and several liability for any outstanding balance and for compliance with these Terms
5.2 Transfers are free of charge. We reserve the right to refuse a transfer at our reasonable discretion, including where the proposed replacement does not meet our eligibility criteria.
5.3 Once a transfer is approved and completed, the original participant has no further claim against us in relation to that booking.
6. CANCELLATION, AMENDMENT, OR DELAY BY US
6.1 We reserve the right to cancel, postpone, or materially alter an Event due to circumstances beyond our reasonable control ("Force Majeure"), including but not limited to: natural disasters, extreme weather, political instability, civil unrest, government travel advisories, pandemic-related restrictions, or insufficient participant numbers to safely or viably run the Event.
6.2 If we cancel an Event under Section 6.1, you will receive, at our discretion, either a full refund of all monies paid or the option to transfer your booking to a future Event of equivalent value.
6.3 We are not liable for any indirect or consequential losses arising from a cancellation or alteration under this section, including but not limited to flights, visas, or other travel arrangements booked independently of us. This is why travel insurance is a condition of participation (Section 11).
6.4 Where we make a minor change to the itinerary that does not materially affect the nature of the Event, no compensation or refund will be due.
7. ELIGIBILITY
7.1 Participants must be aged 18 or over at the time of the Event.
7.2 Any participant intending to drive must hold a valid full driving licence permitting them to drive a manual vehicle, valid in the country of operation. It is the participant's sole responsibility to confirm their licence meets this requirement before booking.
7.3 We reserve the right to request evidence of a valid licence prior to departure and to refuse participation, without refund, where this cannot be provided.
7.4 We reserve the right, at our reasonable discretion, to decline a booking or remove a participant from the Event where we believe participation poses a safety risk to that individual or others.
8. VEHICLES
8.1 Vehicles are provided for use during the rally only and must not be used outside designated rally routes without our prior written consent.
8.2 Participants are jointly responsible for any damage caused to the vehicle through negligent, reckless, or wilful conduct during their period of use. Fair wear and tear arising from normal use of the vehicle on the designated route is excluded.
8.3 Vehicles must be returned in a reasonable condition, accounting for the nature of off-road and unpaved travel, at the conclusion of the Event. Any damage beyond fair wear and tear will be assessed, and the reasonable cost of repair may be charged to the responsible participant(s).
8.4 Participants must not drive under the influence of alcohol or drugs. Breach of this condition will result in immediate removal from the Event without refund and may result in the participant being held liable for any resulting loss or damage.
8.5 Participants are responsible for driving in accordance with all applicable local road laws and regulations during the Event.
9. PARTICIPANT RESPONSIBILITY AND CONDUCT
9.1 Participants take part in The Dusty Dash entirely at their own risk. The Event involves self-drive travel on roads that may be unpaved, remote, or in variable condition, in regions where infrastructure, medical facilities, and emergency response may be limited.
9.2 Travel insurance is a condition of participation. See Section 11.
9.3 We reserve the right to remove any participant from the Event whose behaviour is deemed by us, acting reasonably, to endanger themselves, other participants, or third parties, or who breaches these Terms. No refund will be issued where a participant is removed under this Section.
9.4 Participants must comply with all reasonable instructions given by event staff or organisers during the Event for safety and operational reasons.
10. LIABILITY
10.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
10.2 Subject to Section 10.1, we shall not be liable for any injury, illness, death, loss, damage, expense, or inconvenience suffered by any participant arising from their participation in the Event, including but not limited to risks inherent in self-drive travel on remote or unpaved roads.
10.3 Subject to Section 10.1, our total liability to you in connection with your booking shall not exceed the total amount paid by you for that booking.
10.4 We are not responsible for the acts, omissions, or default of independent third-party suppliers, including accommodation providers, event venues, vehicle suppliers, or local operators, except where we have been negligent in selecting them.
10.5 We are not liable for any loss or damage to personal belongings brought on the Event.
11. TRAVEL INSURANCE
11.1 Comprehensive travel insurance is mandatory and is a condition of participation in the Event. Your policy must, as a minimum, cover: medical expenses, emergency evacuation and repatriation, personal liability, cancellation, and self-drive vehicle activities in the relevant region.
11.2 You must provide evidence of valid travel insurance prior to departure if requested. Failure to do so may result in being refused participation, without refund.
11.3 We accept no liability for any losses, costs, or expenses arising from your failure to hold adequate travel insurance.
12. DATA PROTECTION
12.1 Any personal information you provide to us in connection with your booking will be processed in accordance with our Privacy Policy, available at thedustydash.com/privacy-policy.
13. INTELLECTUAL PROPERTY
13.1 All content on our website and associated materials, including but not limited to text, branding, logos, and images, is owned by or licensed to us and may not be reproduced or used without our prior written consent.
14. GENERAL
14.1 Severability. If any provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision will be deemed deleted, and the remaining provisions will continue in full force and effect.
14.2 Entire Agreement. These Terms, together with our Privacy Policy and any written confirmation of booking we provide, constitute the entire agreement between you and us in relation to your booking, and supersede any prior agreement, representation, or understanding, whether oral or written.
14.3 Assignment. You may not assign or transfer your rights or obligations under these Terms except as expressly permitted under Section 5 (Participant Transfers). We may assign or transfer our rights and obligations under these Terms to a third party, including in connection with a business transfer, provided this does not materially affect your rights under these Terms.
14.4 Waiver. No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy.
14.5 Notices. Any notice required to be given under these Terms must be in writing and sent to the contact details set out in Section 1.4, or to the address you provided at the time of booking.
14.6 Third-Party Rights. Except as expressly stated, these Terms do not give rise to any rights for any person other than you and us.
15. GOVERNING LAW AND JURISDICTION
15.1 These Terms are governed by the laws of England and Wales.
15.2 Any dispute arising out of or in connection with these Terms, or your participation in an Event, shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. CHANGES TO THESE TERMS
16.1 We reserve the right to update these Terms at any time. The version in force at the time you submit your booking will apply to your participation, save where a change is required by law or for safety reasons.
